Terms Condition

By making a reservation you are entering into a legal rental contract with SunnySide Villas, and therefore agree to and are bound by SunnySide Villas terms and conditions:

These Terms and Conditions, along with the confirmation email We send You after You make Your reservation (“info@sunnysidevillas”), form a binding contract between You and Us, effective as of 24 hours after We send the Confirmation Email to You (with the agreement date).

In these Terms and Conditions, “Agreement” means these Terms and Conditions and the Confirmation Email collectively. “You” and “Your” means the person or persons making the reservation and those who will be staying at the property as guests. “We,” “Our,” “Ours,” and “Us” means Sunnyside Villas Vacation Rental, LLC.

Terms and Conditions of Rental

  1. Rejection of Agreement

By making a reservation and payment or any other means, You are agreeing to accept or reject this Agreement within 24 hours of Our sending You the Confirmation Email. To reject this Agreement, You must respond to the Confirmation Email at info@sunnysidevillas.com and notify Us that You wish to reject this Agreement. If You do not reject this Agreement within 24 hours of Our sending the Confirmation Email, You will automatically be deemed to have accepted this Agreement.

  1. Reservation

Subject to the terms and conditions of this Agreement, You will rent the Property solely for short-term vacation purposes between the “Check-In Date” and “Check-Out Date” identified in the Confirmation Email. Your lease of the Property will start at 4:00 p.m. on the Check-In Date and will end at 10:00 a.m.

A check-out after 10:00 am without our permission may be accurate in a late check-out fee.

If You fail to check out and give Us possession of the Property on time on the Check-Out Date, We may charge You daily rent for the time You holdover at a rate equal to the lesser of: (a) 200% of the amount of the daily rent set forth in the Confirmation Email; or (b) the maximum rate permitted by applicable law.

  1. Rent and Other Charges.

You will pay Us the full amount of rent, taxes, and other fees stated in the Confirmation Email (collectively, “Total Charges”). Rent may be combined with other Fees and will be stated in the Confirmation Email.

. Payment Deadlines. If Your Agreement Date is less than 60 days before check-in, You authorize Us to charge 100% of the Total Charges to Your credit card when You make the reservation. If Your Agreement Date is 60 days or more before Your check-in date, You authorize Us to charge 50% of the Total Charges to Your credit card when You make the reservation and charge the remaining 50% to Your credit card 60 days before Your Check-In Date (“Second-Charge Date”).

. Authorization. You authorize Us to charge Your credit card on file without any further notice to You on the Second-Charge Date. If 100% of the Total Charges aren’t paid to Us by the Second-Charge Date, We may cancel Your reservation at any time.

. Nonrefundable Reservation Fees. “Non-refundable Reservation Fees” may be combined with Rent and are included in the Total Charges. Nonrefundable Reservation Fees means cleaning fee, extra dirty, early check-in, late check-out, cancellations, travel-agent (Airbnb, booking.com, home away marketing, etc.), pet, accidental damage waiver, customer care as stated in the Confirmation Email as well as any other fees (if any) designated in the Confirmation Email. Nonrefundable Reservation Fees are fully earned by Us on the Agreement Date. Except as otherwise set forth in this Agreement or otherwise required by applicable law, We have no obligation to refund the Nonrefundable Reservation Fees to You for any reason, even if: (1) We cancel Your reservation because You failed to pay 100% of the Total Charges by the Second-Charge Date; or (2) You cancel Your reservation (even if You cancel before the Cancellation Deadline referred to below).

. Security Deposit and Additional Charges.

(1) Certain charges may be designated as a “Security Deposit” in the Confirmation Email. To the fullest extent permitted by applicable law, We may deduct from the Security Deposit any costs for damages, extra cleaning, or repair of the Property, furniture, and other items in the Property which You cause or permit to occur, plus any sales tax, general excise tax, transient accommodations tax, and any other applicable taxes.

(2) If the Security Deposit is not sufficient to cover any costs or damages caused by You or for which You are responsible under this Agreement, You will be responsible for paying Us the difference promptly upon Our request.
At the time of your booking, you will be required to pay a non-refundable deposit in cleared funds of between 20-50% (you will be informed of the amount) of the full amount payable (excluding any security deposit or accidental damage insurance fee) in order to secure the villa and selected dates (unless at the time of booking your arrival date is 60 days or less away, in which case clause 8.3 applies).
The balance of the villa cost plus, where required the accidental damage insurance fee (see clause 10) must be received in cleared funds by us no less than 60 days before your arrival date. If we do not receive full payment in cleared funds in full and on time, we reserve the right to treat your booking as canceled by you in which case the cancellation charges set out in clause 26 will become payable by you.
If your arrival date is 60 days or less away on booking then the full amount including the villa damage insurance fee if required, must be paid on booking.
Should you instruct your credit/debit card company to “chargeback” any payment(s) properly due from you in respect of your booking, we further reserve the right to cancel your booking and/or take legal action against you for all outstanding payments in the event that a “chargeback” is made.
In the event that a reservation is made within 14 days of arrival and payment is made via debit/credit card, the following supporting documents must be provided in order to secure the reservation:
(a) a copy of the front & back of the payment card
(b) a copy of the cardholder’s identification (drivers license/passport)
(c) proof of cardholders address (recent utility bill/statement)

  1. Prices All prices quoted include all taxes.
    Prices quoted on our website and in our brochure are those in effect at the time of viewing only. Prices are updated from time to time and are only guaranteed once the deposit (see clause 8.1 below) has been paid (although we reserve the right to change prices at any time in the case of error).
  2. Booking your villa

By creating a Villa, the first name on the booking will be the main person and will be speaking on behalf of all other guests detailed on that same booking:
(a) the details they are providing are complete and accurate;
(b) he/she has read these Terms and has the authority to, and does agree to be, bound by them;
(c) he/she consents to us using any information provided in accordance with our Privacy Policy;
(d) he/she is over 25 years of age and when placing an order for services with age restrictions, declares that he/she and all members of the party are of the appropriate age to purchase those services.
When you submit a booking to us, this does not mean we have accepted your booking. Our acceptance of the booking will take place as described in clause 1.3 (when a binding contract is entered into).

If we are unable to fulfill the booking, we will inform you of this and we will not process the booking further.

  1. Accuracy

Since we are not the management company and the villa owner, they have the right to change the interior room configurations, the furnishings, the fixtures and fittings of the villa, and all other equipment in, or appearance of, the villa without giving prior notice to you.

Before your booking is submitted you must check the price and all other details relating to the villa and any other arrangements that you wish to book.

  1. Changes to the booking

All the requests for changes must be sent by writing to info@sunnysidevillas.com but we can not guarantee that the changes will be accepted. Including date changes.

  1. Your rights to cancel Once a binding contract has been entered into to cancel the entire booking or any component, the person making the booking must notify us in writing. If you cancel you will lose your deposit and any other sums you have paid us (including if you have paid for the full cost of the villa).
  2. COVID-19 exposure

By renting a Sunnyside Villa Home, you voluntarily assume all risks related to exposure to COVID-19.
Here’s what You can do:

(1) Staying healthy and mitigating the risk of contracting COVID-19 will require Your help. Protect yourself and exercise social responsibility. Maintain at least six (6) feet of social distancing from others when possible. Wear a mask, particularly in places like grocery stores and other public-serving businesses. Wash Your hands using soap and water for at least twenty (20) seconds as frequently as possible. Carry hand sanitizer and use it frequently. During Your stay, regularly clean and wipe down high-touch surfaces. Clean and wipe down personal items such as phones and wallets, and clean areas inside of Your vehicles, such as steering wheels. Avoid contact with others who are sick. If You feel sick, isolate yourself from others and seek medical attention.

  1. Complaints and your protection

If you have cause for complaint whilst staying in the villa, this must be brought to the management company’s attention immediately so that action can be taken at the time to rectify the problem. Should the management company be unable to resolve the matter, details of the complaint must be notified to us in writing within 3 days of the end of your stay. Failure to do so will affect our and the management companies’ ability to investigate your complaint and will result in us being unable to consider your complaint. We aim to resolve complaints within a 1 month period from receipt.

  1. Guest Rules

(a) Although We may provide a starter supply of toiletries and amenities (such as toilet paper, dishwasher detergent, and dish-washing liquid, etc.) as a courtesy, We have no obligation to replenish those items. Additional supplies are Your responsibility.

(b) If the Property is equipped with a telephone or digital television, You may not make long-distance telephone calls or order movie or event programming. You will pay Us any long-distance or other telephone toll charges and any movie or event programming charges incurred, together with a 40% surcharge to cover Our administrative costs.

(c) If the Property is equipped with a television, video player, or related or similar electronics, replacement or repair is not guaranteed and no refunds will be given for malfunctions of such equipment.

(d) If the property is equipped with a dishwasher, washing machine, dryer or any other large appliance, replacement or repair is not guaranteed and no refunds will be given for malfunctions of such equipment/and or is at the discretion of the homeowner.

(e) You will not give access to or permit any guests or occupants in the Property other than the individual or individuals specifically identified as You in this Agreement.

(f) You assume responsibility for any damages to or theft from the Property, including towels and linens.

(g) You may not place wood, paper, or any other combustible materials in any gas fireplace.

(h) You may not make any alterations to the Property or its improvements, furniture, equipment, or other furnishings.

(i) A Pet Fee is applicable for stays at properties that are Pet Friendly.

(j) Smoking is strictly prohibited in or on the Property, or in any common areas near the Property. Violations will result in an automatic $500 fine plus the cost of carpet/upholstery cleaning, and any other damages as a result.

(k) After-hours lockout calls to a locksmith and related expenses incurred are Your responsibility.

(l) Grilling is only permitted on grills. Propane refills may be undertaken only by Us, provided such refills will occur only during normal business following Your request that We do so. Charcoal may not be placed or burned within any gas grill.

(m) You are responsible for Your own vehicle, including (but not limited to) damage or additional wear and tear resulting from coastal driving (if applicable) and related hazards thereto, and towing or other charges. We do not provide towing or roadside assistance reimbursement, regardless of the type of the vehicle or road, or weather conditions. The host does not accept liability for any inconveniences, delays, or your inability to booking in a Unit arising from any temporary or permanent defects or stoppage in supply of water, gas, electricity or plumbing, damage caused by weather, road closures or conditions, construction, natural disasters, disruption or cancellation of your travel, events, conferences or reason for your booking, government orders, pandemics, viruses, illnesses, infestations, water conditions, closings, pollution, acts of God or other reasons beyond our control. No refunds will be given for any delays or cancellations due to such conditions. Accordingly, travel insurance with “cancel for any reason” terms is highly recommended for all bookings and may be purchased online or with an agent. Exceptions can be given to allow rescheduling or guest credits. Proper documentation of extenuating circumstances (illness, death, etc.) will be required, and final approval will be at the discretion of the host.

(n) Quiet time is from 9:00 p.m. to 9:00 a.m. If a noise complaint is reported, You will be charged $100 for the first complaint and $200 for each additional complaint.

(o) You must maintain the Property in as good a condition as You received it, including but not limited to:

(1) keeping the Property safe and clean;

(2) not causing or permitting any unsafe or unsanitary conditions in the area surrounding the Property;

(3) disposing of all ashes, rubbish, garbage, and other waste in the provided trash receptacles;

(4) properly securing lids on trash receptacles at all times;

(5) not leaving trash on porches, decks, or any other exterior location;

(6) not destroying, defacing, damaging, or removing any part of the Property or rendering inoperable any smoke detector.

(p) We do not guarantee Wi-Fi uptime, speeds, or reliability for work or other purposes. No refund will be given due to power outage, fuel, water, gas, steam, refrigerant, sewerage, telephone, or internet services due to external factors.

(q) No refunds for issues reported after check-out. Property issues must be reported to the host within 24 hours of a check-in including pictures validating the said claim.

(r) You must promptly notify Us of the need for replacement of or repairs to any stove, fireplace, hot tub, smoke detector, or other appliance or fixture at Property, and any other problems with or at the Property.

(s) We are not responsible for the condition or upkeep, repair, or maintenance of any such common areas.

(t) All non-transient vacation uses (including but not limited to parties, weddings, receptions, and similar events and activities) are strictly prohibited. You may not use the Property or permit the Property to be used in any way that interferes with any other guest’s, tenant’s, or owner’s use and enjoyment of property near to the Property.

(u) You must comply with all other House, Owners’ Association, and other Rules and Regulations applicable to the Property. All such Rules and Regulations are a part of this Agreement and are incorporated into this Agreement by reference.

(v) You will comply with all, and will not violate any, federal, state, and local laws and regulations applicable to the Property.

(w) You are responsible for all items You bring into the property. We can check for Your lost or forgotten items in the property at Our earliest convenience, but cannot guarantee that lost or forgotten items will be found and returned to You. We are not responsible for Your lost or forgotten items.

  1. Your duty

No other persons are permitted to stay at the villa other than those named on the booking form and under no circumstances may more than the maximum number of persons specified in the villa description occupy the property (except by prior written agreement with us).
Breach of a clause may result in your eviction from the villa and/or additional guests being asked to vacate and in this event, you will not be entitled to a refund. We and our agents reserve the right of entry to the villa at any time.
You and all members of your party agree not to use the property for any illegal or commercial purpose, including subletting.
On departure, you should leave the villa in a reasonably clean and tidy condition so that it can be efficiently prepared for the next guests. This includes disposing of all rubbish before you leave (information relating to rubbish disposal including bin collection dates can be found in the villa guide provided by the management company). Excess rubbish left on your departure day will be charged at the rate agreed by the individual homeowner.
Excessive cleaning required will also be charged at the rate agreed by the individual homeowner. All charges will clearly be displayed in the guide located in the villa If excess rubbish must be cleared or excessive cleaning of the villa is necessary following your stay, any charges will either be:
(a) deducted from your security deposit, or
(b) invoiced to your postal address;
. You must let the villa management company know immediately if you identify any damage to the villa or its contents, or if something gets broken, stained, marked, or damaged in the villa during your stay so that remedial action can be undertaken as soon as possible.
For security and legal reasons, we and the resort do not accept packages, parcels, or letters to our offices or homes on behalf of guests. The resort, owner, or Sunnyside are not liable for any losses of packages that are sent to our offices or one of our vacation homes.

  1. Passport and VISA requirements

14.1. All travelers must possess valid passports and any visas required. All Brazilian citizens require a full 10-year passport valid for a period of at least 6 months beyond their holiday return date.

  1. Pest control

We cannot accept any responsibility for any disruption caused to your holiday by insects or other pests where this was outside of our reasonable control.

  1. Weddings and corporate events Parties, weddings, and corporate events are strictly prohibited in all of our villas. Violation of this rule will result in us being entitled to:
    (a) evict you from the villa with immediate effect (and in this event, you will not be entitled to a refund); and/or
    (b) invoice you for the additional charge that would have been payable by you had you sought our prior permission to hold the event and such permission had been granted. Such invoices shall be payable by you to us within 14 days of receipt.
    The rental property is not to be used to host parties, events, or social/group gatherings. Only guests whose names are on the Rental Agreement are authorized to stay in the rental property. Any guest having an event, party, or social/group gathering in the property or exceeding the numbers of authorized guests will be removed without refund. Additionally, if it is discovered upcoming guests are hosting a party, event, or social/group gathering in one of Sunnyside Villas’s rental properties, Sunnyside Villas reserves the right to cancel the reservation prior to the guest’s stay, with recompense at Sunnyside Villas judgment.
  2. Pool terms and conditions

Use of the pool is entirely at your own risk. It is particularly important that children are supervised at all times in and around the pool areas. For your children’s safety, all-villa to pool doors is alarmed. Tampering or disconnecting these devices is a criminal offense.
Pool, spa, and hot tub heat are not included as standard with any villa. At the time of booking, you will be given the option of paying an additional fee for such heat on a daily rate basis.
In the event that you opt to pay an additional fee for pool, spa, and/or hot tub heat and during your stay the pool, spa, and/or hot tub heating fails, you shall be entitled to a refund of the daily rate paid for each day of heating failure. You shall not be entitled to any other compensation in the event that pool, spa, and/or hot tub heating fails.
Where included with your booking, pool heating in most villas is set to come on from early morning and is turned off during the night. However, the times the pool heating is set will be at the discretion of the villa owner or management company.
We cannot accept any liability for the failure of pool heat to provide adequate heating where pool heat is provided via an electrical heat pump and where the outside air temperature drops below 55 degrees Fahrenheit. Electric heating pumps do not operate effectively below this temperature, and the failure of such devices to heat the pool is outside of our control. In most cases, your pool will warm to a daytime temperature of between 70 and 80 degrees.
